Putative offence – Lötscher

The putative offence is behaviour which the perpetrator mistakenly assumes to be an offence. It is unpunished despite the reprehensible subjective attitude of the perpetrator. The putative emergency defence is the actual error ϋber the existence of a self-defence situation.
