Deviation from constant practice
are prerequisites for deviation from constant practice: The amended interpretation of a particular legal provision must be the result of a serious and thorough recent examination of the question and must be based on grounds which, according to general rules of interpretation, are capable of supporting the assumption that the real intention of the law is different from that which has been assumed so far, i.e. an error of interpretation.
